Terms of Use

This Terms of Use Agreement sets forth the standards of use of the DrawPlan mobile application and related services (“Product”). By using DrawPlan, you (“the User”) agree to these terms and conditions. If you do not agree, you should immediately discontinue use of the application. We reserve the right to modify, alter, or update these terms at any time without prior notice. Modifications become effective immediately upon being posted at www.DrawPlan.net. Your continued use of the Product after amendments are posted constitutes acceptance of the updated Agreement.

1 Description of Product and Service

DrawPlan provides the User with a mobile application for creating 2D floor plans and spatial layouts. The application is available on iOS (iPhone and iPad) and Android devices. Certain features may utilise your device’s internet connection, camera, or other services. The User is responsible for any fees charged by their mobile carrier or internet service provider related to data usage while using DrawPlan.

2 Membership and Subscription Terms

DrawPlan is free to download and use with a set of standard features at no charge. The User may optionally upgrade to a Pro Plan subscription, which unlocks additional features and capabilities. Pro Plan subscriptions are available as monthly or annual plans and are purchased through the Apple App Store or Google Play Store.

Subscription payments are charged in advance on a recurring basis (monthly or annually) and will automatically renew unless cancelled by the User. The User will be charged at the rate in effect at the time of renewal. Subscriptions can be cancelled at any time by the User through the store from which they purchased it (Apple App Store or Google Play Store). DrawPlan may also discontinue a subscription at its sole discretion.

In-app subscription purchases are non-refundable. Refund requests must be directed to Apple or Google, as applicable, in accordance with their respective refund policies. The User is responsible for managing their subscription, including updating payment information and cancelling their subscription directly through Apple or Google.

3 Communications

The User agrees to allow DrawPlan to send information regarding the Product and Service from time to time. This information may include product updates, feature announcements, promotional offers, or other relevant communications. DrawPlan may contact the User via email or in-app notifications. The User may opt out of receiving such communications at any time by following the unsubscribe instructions provided in the communication or by adjusting notification settings on their device. 4 Disclaimer of Warranties

The Product is provided by DrawPlan on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, DrawPlan makes no representations or warranties of any kind, express or implied, regarding the use or results of the Product in terms of its correctness, accuracy, reliability, or otherwise.

DrawPlan disclaims all warranties with regard to the information provided, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DrawPlan shall have no liability for any interruptions in the use of the Product. Some jurisdictions do not allow the exclusion of implied warranties; therefore the above exclusions may not apply to you.

DrawPlan does not warrant that the Product will operate error-free or that the application or its servers are free of viruses or other harmful components. If your use of DrawPlan results in the need for servicing or replacing equipment or data, DrawPlan is not responsible for those costs.

5 Limitation of Liability

To the maximum extent permitted by applicable law, DrawPlan shall not be liable for any damages whatsoever, including but not limited to special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to the DrawPlan application or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if DrawPlan has been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages; therefore some of the above limitations may not apply to you.

6 Indemnification

Users agree to indemnify and hold DrawPlan, its parents, subsidiaries, affiliates, officers, and employees harmless from any claim or demand, including reasonable legal fees, made by any third party arising out of the User’s use of the Product, violation of this Agreement, or infringement of any intellectual property or other right of any person or entity.

7 Acceptable Use

Users agree not to use the Product to:

• Upload, transmit, or share any content that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable
• Harm minors in any way
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload or transmit any content that you do not have the right to share under applicable law or contractual obligations
• Upload or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
• Upload or transmit any material containing software viruses or code designed to disrupt, damage, or limit the functionality of any software, hardware, or network
• Interfere with or disrupt the Product, its servers, or connected networks, or violate any requirements, procedures, or policies of connected networks
• Attempt to reverse-engineer, decompile, or extract the source code of the application or any part thereof

DrawPlan reserves the right, but is not obligated, to monitor content and usage to determine compliance with this Agreement and to satisfy any applicable law or regulation. DrawPlan may, at its sole discretion, remove any material or restrict access to the Product.

8 Modifications and Interruption to Service

DrawPlan reserves the right to modify, update, or discontinue the Product or any of its features at any time, with or without notice. DrawPlan shall not be liable to the User or any third party for exercising this right. The User acknowledges that DrawPlan does not guarantee continuous, uninterrupted, or secure access to the application, and that operation may be affected by factors outside of DrawPlan’s control.

9 Governing Law

This Agreement and the use of the DrawPlan application are governed by and construed in accordance with the laws of the State of Colorado, United States, without giving effect to any choice of law provisions. By using DrawPlan, you agree to submit to the jurisdiction of the courts of the State of Colorado for the resolution of any disputes arising under this Agreement.

10 Compliance with Laws

The User assumes all knowledge of applicable law and is responsible for compliance with any such laws. The User may not use the Product in any way that violates applicable state, federal, or international laws, regulations, or other government requirements.

11 Intellectual Property

All content included in the DrawPlan application, including but not limited to design, text, graphics, icons, interfaces, and the selection and arrangement thereof, is the property of DrawPlan and/or third parties and is protected by intellectual property laws. Any reproduction, modification, distribution, or commercial exploitation of the application’s content without prior written permission from DrawPlan is strictly prohibited. Users agree not to use any automated tools, bots, or manual processes to copy, extract, or mine content from the DrawPlan application.

12 General Provisions

If any provision of this Agreement is found to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the maximum possible extent. This Agreement may be assigned by DrawPlan to a third party in the event of a merger, acquisition, or other corporate transaction. By accepting this Agreement, the User consents to the use and disclosure of their information as described in our Privacy Policy.
